Job Title: Real Estate Lawyer
Location: Goa
Reports To: Head of Legal / General Counsel
Job Summary: The Real Estate Lawyer is responsible for providing legal counsel and representation in matters related to real estate litigation and land acquisition. This role requires extensive knowledge of real estate law, strong litigation skills, and the ability to manage complex land acquisition transactions. The ideal candidate will ensure compliance with all legal requirements, mitigate risks, and protect the company's interests in real estate dealings.
Key Responsibilities:
1. Real Estate Litigation:
Represent the company in real estate litigation matters, including disputes over property boundaries, title issues, landlord-tenant conflicts, and zoning laws.
Prepare and file legal documents, including pleadings, motions, and briefs.
Conduct legal research to support litigation strategies and advise on potential outcomes.
Negotiate settlements and resolve disputes through mediation or arbitration when appropriate.
Collaborate with external legal counsel and manage litigation budgets.
2. Land Acquisition:
Provide legal advice and support for land acquisition transactions, including drafting, reviewing, and negotiating purchase agreements, sale deeds, and other related documents.
Conduct due diligence on potential land acquisitions, including title searches, environmental assessments, and zoning compliance.
Ensure all land acquisitions comply with local, state, and federal laws and regulations.
Liaise with government agencies, landowners, real estate agents, and other stakeholders to facilitate smooth transactions.
Address and resolve any legal issues that arise during the acquisition process.
3. Contract Management:
Draft, review, and negotiate various real estate contracts, including leases, easements, and development agreements.
Ensure all contracts are legally sound and protect the company's interests.
Monitor contract performance and compliance, addressing any breaches or disputes.
4. Regulatory Compliance:
Stay informed about changes in real estate laws and regulations that may impact the company.
Advise senior management and other departments on regulatory compliance and risk management.
Implement and maintain policies and procedures to ensure ongoing compliance with legal requirements.
5. Risk Management:
Identify potential legal risks related to real estate transactions and develop strategies to mitigate them.
Conduct risk assessments and provide recommendations to senior management.
Ensure proper documentation and record-keeping for all real estate transactions and litigation matters.
6. Client and Stakeholder Communication:
Serve as the primary legal contact for real estate matters, providing clear and concise legal advice to internal clients and stakeholders.
Prepare and present legal reports and updates to senior management and the board of directors.
Build and maintain strong relationships with external legal counsel, real estate professionals, and government authorities.
Qualifications:
Juris Doctor (JD) degree from an accredited law school.
Admitted to the bar and in good standing in [relevant jurisdiction].
Minimum of 5-10 years of experience in real estate law, with a focus on litigation and land acquisition.
Strong knowledge of real estate law, property law, contract law, and regulatory compliance.
Excellent legal research, writing, and analytical skills.
Proven ability to manage complex litigation and land acquisition transactions.
Strong negotiation, communication, and interpersonal skills.
Proficiency in legal research tools and Microsoft Office Suite.
