About this opportunity
We are looking for Senior Counsel, India to serve as a strategic business partner providing support for a broad spectrum of legal matters in one of our fastest growing markets in APAC. You will work as part of a regional legal team of 10 lawyers and will report to Legal Director for India.
LOCATION: Mumbai (India)
TRAVEL: Domestic travel may be required up to 20% and international travel may be required up to 10% of time.
In this role, you will…
Be a proactive, agile, and commercially-minded business partner to internal stakeholders.
Drafting, reviewing, negotiating or otherwise providing legal support to the various types of contracts and commercial transactions arising from the fast-growing business of Align Technology in India.
Providing support in reviewing marketing proposals and collaterals and educating marketing team to ensure compliance with local laws, regulations and codes which apply to medical devices in the field of advertising, promotion and labelling.
Providing general support in other legal and regulatory aspects of the activities of Align Technology in India, such as trademark enforcement and brand protection, anti-bribery compliance, anti-trust issues.
Monitoring major legislative developments and regulatory changes that is relevant to Align Technology and updating legal and commercial teams accordingly.
Counsel, advise and train the India team on general corporate legal and compliance matters.
Work with regional and global counterparts on global projects, process improvement aspects for the Legal function.
Ensure compliance with Align’s contract management process, along with company policies and procedures.
The role will focus primarily on India, with potential opportunities to provide support and lead regional matters in APAC over time as you progress with us
In this role, you’ll need …
EDUCATION and/or EXPERIENCE
LLB with strong academic credentials from a leading national university in India.
7+ years of relevant legal experience preferably in medical technologies, medical services, medical devices, pharmaceuticals or other related business at a law firm, in-house, or combination of both.
Experience working in a global, multinational company with ability and interest to support a high-growth business. Experience of managing legal matters in India is a must.
Experience with and strong working knowledge of applicable commercial legal principles.
Experience and knowledge in the area of FCPA, anti-bribery and other compliance matters or investigations is a plus.
SKILLS AND ABILITIES
A pleasant personality with good interpersonal skills, including, but not limited to, a positive attitude and sense of humour!
Fluency in English, together with excellent drafting skills.
Experience in contracts, distributorship, sales and marketing support, other commercial activities and general corporate matters required.
Experience in medical device, pharmaceutical, or other healthcare sectors would be a plus.
Experience in advertising and promotion compliance (especially, consumer-facing marketing), brand protection and trademark enforcement, and anti-bribery compliance preferred.
Ability to work independently with minimal supervision, and contribute to the development and growth of other junior lawyers who are part of the legal team.
Strong verbal and written communication skills and ability to communicate effectively with a broad audience including legal, business, marketing and highly specialized technical individuals.
Ability to multi-task, prioritise work and perform in a very fast-paced, high growth, and rapidly changing business environment.
Strong work ethic with a commitment to ensure that all deadlines are met on time and with a high degree of quality.
Proven ability to frame, draft and negotiate both routine and bespoke agreements
