Job Description
Role Purpose The role is accountable for managing all litigations filed by and against the company, devising formulation and deployment of appropriate strategies to ensure a favourable outcome and maximze organizational benefit
Role Accountability Head Litigation for Litigations filed against the company and FCU litigations by and against the company
Responsible for handling all litigations against SBI card to minimize any financial & reputational risk. The litigations include and not restricted to cases filed before the Consumer Forums, Civil Courts, High Courts , quasi judicial forums, cases under IT act etc
Responsible for partnering, decision making with the management on litigation cases as well as advising in Banking Ombudsman & customer escalation cases
The incumbent would also take lead in strategizing and managing FCU litigations and police complaints by and against the company pertaining to the subject & optimize recovery of fraud loss through LEA engagement
Drafting & reviewing replies filed before the Various Courts and regulators (Including RBI) to mitigate any regulatory risk
Provide Case details & other investigation inputs for all police correspondence / notices & handle escalations that pertains to police /CBI etc
Ensure adequate infrastructure and framework including the right resourcing, empanelment of the LEA consultants
Be the key advisor / central support in all LEA liaison matters (Police HQ & Bank Fraud Section / EOW / Cyber Cell etc) for resolution of issues raised during day-to-day activities & tracking the developments of the complaints lodged by the Company in all high value / employee pertaining to fraud cases
Liaisoning and/ or working with various external counsels, retained to represent or assist in India and advise them to take stand in the matters/ cases basis the latest case laws and trends and ruling in the interest of company. Formulating EWS for handling & curbing legal/ quasi legal / customer escalations/ process improvements basis inputs received through precedents
Managing legal expenses and costs for litigation vertical
Helping to develop risk management program and policies to curb the inflow of cases filed against the Company
Proactive support in handling police escalations/ harassment by customers/ suicide threats etc
Reply to Legal notices/ 91 CRPC/ RTI/ summons any notice issued by LEA/ Judicial authorities
Also member of Legal and Disputes settlement committee and owner of the same for settling the issues of customers before filing cases or Pre Litigation Disputes and also cases filed in Courts along with other SMT members
Attending the hearings before Courts/Tribunals/Labor Courts/ Labor Commissioner /other authorities to make submissions on behalf of SBI Card
Handling Fraud escalations & Police complaints to be filed before the various authorities (LEA, cyber crime cells etc)
Devising strategy & scientific management of litigation filed against the organization (settlement/LOK ADALAT/ Conciliation etc)
Measures of Success monitoring and management of litigation filed against the company and filing of complaints in the police stations against the fraudstes
proper monitoring and recovery in fraud cases
timely management and answering all notices legal/statutory under Cr PC received agaisnt the company
Decrease in Inflow; Increase in Closure; Claim Vs. Paid Ratio; Win Ratio
Number of LEA trainings done periodically
