Position: Manager- Litigation
Location: Delhi
Reports to: General Manager- Legal
Role Summary
Experienced lawyer with litigation background, not less than 5 years' experience, who will be responsible for handling court matters and providing advisories on disputes/ potential disputes in the day-to-day operations of the business teams.
Key Responsibilities
Handling Court cases and assisting external counsels and senior counsels in drafting, filing and briefing of petitions.
Work closely with external lawyers representing the Company before Courts, tribunals and other judicial/ quasi-judicial authorities, providing support, setting strategy, preparing arguments and drafting submissions to ensure strategic impact.
Identifying and implementation of Judgements which impact the Company/ Industry.
Sound knowledge of Telecom / Media and Broadcasting / DTH background, litigation process and local laws.
General area of practise preferably includes knowledge in the below fields.
Telecom Regulatory Authority of India Act - Regulations and Orders and matters before the Telecom Disputes and Settlement Appellate tribunal.
The Indian Trademarks and Copyright Act - Civil and Criminal enforcement actions including infringements and unauthorised use.
Labour Codes and various statues impacting employment laws.
Alternate disputes redressal including arbitration and mediation.
Handling civil and criminal matters before the appropriate authorities and handling writ matters before High Court and Supreme Courts.
Ability to partner with various functions including tax team and understanding tax provisions and advising on challenges before the Writ Courts.
Basic understanding of Customs and Excise matters.
Advising business team on various issues including, legal metrology, Competition Act, Contractual Agreements etc.
Able to work independently on diverse areas of law and translate discussions and ideas into concrete actions.
