Verifyin, a leading background verification product by Gigin Technology, provides comprehensive employment background checks to ensure trust and safety in hiring. As we expand our services into the US market, we seek a highly skilled and experienced Background Verification Lawyer to ensure that our operations align with US legal standards. This role will be based out of India and will focus on providing legal support for our Verifyin product.

Job Summary:

The Background Verification Lawyer will be responsible for ensuring that Verifyin’s background verification processes comply with US legal standards, including federal and state regulations. The ideal candidate will possess deep knowledge of US employment law, data privacy regulations, and background verification industry practices. This role involves close collaboration with legal, compliance, product, and technology teams to ensure that our Verifyin product meets all relevant legal and regulatory requirements.

Key Responsibilities:

Legal Compliance: Ensure that all background verification processes for the Verifyin product comply with US federal and state laws, including the Fair Credit Reporting Act (FCRA), Equal Employment Opportunity (EEO) regulations, and applicable data privacy laws such as CCPA.

Contract Review and Management: Draft, review, and negotiate contracts related to Verifyin, including agreements with US clients and vendors, ensuring they are legally sound and in line with company interests.

Risk Management: Identify legal risks in the background verification processes and work proactively to mitigate these risks, including developing and enforcing internal policies that align with US legal standards.

Policy Development: Develop and maintain policies and procedures specific to the Verifyin product, ensuring they are up-to-date with US legal requirements and industry best practices.

Legal Advisory: Provide expert legal advice to the Verifyin team on matters related to background verification, data privacy, and compliance with US laws.

Vendor Compliance: Oversee third-party vendors involved in Verifyin's background verification processes, ensuring they meet all legal and compliance standards. Manage contractual relationships, focusing on compliance and liability management.

Litigation Support: Assist in any litigation or disputes arising from background verification issues related to Verifyin in the US market, coordinating with external legal counsel as needed.

Training and Development: Educate and train Verifyin team members on US legal requirements, compliance issues, and best practices in background verification and data privacy.

Qualifications:

Education: Bachelor’s degree in Law (LLB) is required; a Master’s degree (LLM) in Law and a relevant certification in US employment law is must.

Experience: At least 5 years of legal experience in employment law, background verification, or data privacy, with a focus on US regulations. This is a MUST.

Knowledge: Extensive knowledge of US employment laws, FCRA, EEO regulations, and data privacy laws such as CCPA and GDPR. Familiarity with background verification processes and the challenges of cross-border compliance is essential.

Skills: Strong contract drafting and negotiation skills, analytical thinking, problem-solving abilities, and excellent communication skills. Ability to work independently while coordinating with global teams.

Compliance Expertise: Proven track record in managing compliance with legal requirements, especially in relation to background verification services.
