TP Appeal & Specialized Claims Litigation Management: -

Propose the amount that needs to be reserved for each case after consultation with claims team based on case facts and liability in the case.

Vetting and approval of appeal memo, replies, affidavits, and other documents in consultation with the concerned LOBs and HO.

Ensure timely filing of appeal, RP, SLPs within the statutory time limit.

Co-ordination with theSpecialized Claims litigation teams at the HO and Locations, guiding for necessary compliance and decisions for best results.

Formulation of strategy and executing a proper line of action in consultation with the LOBs and Higher officials in all speciated litigation pending before the NCDRC and the Supreme Court in collaboration with team, advocates, team of LOBs.

Assistance and guidance to Panel Advocates, Team for Specialized Claims pending before the NCDRC and the Supreme Court.

Maintaining TAT for Compliance, Filing of appeals etc. before the NCDRC and the Supreme Court.

Be abreast with the latest case laws and precedents to arrive at a judicious decision while defending a claim or suggesting for compromise or for compliance of an award.

Monitor new judgments/ updates in existing judgments passed by legal system to evaluate their impact on BAGIC’s business and prepare for managing it.

Specialized Claims Litigation Management: -

Co-ordination with other LOBs for filing reply, affidavits, evidence within stipulated statutory time limit pending before the NCDRC and the Supreme Court.

Responsible for discussion and implementation of decisions on award passed in cases pending before the NCDRC and the Supreme Court.

Provide guidance and support to LOBs for the trends in the light of the updated trend of the courts decided by the NCDRC and the Supreme Court.

Discussion with the zonal in-charge at the location and approval of Reply, Affidavits, Argument and Self-Contained Notes (SCNs) to be filed in cases pending before the NCDRC and the Supreme Court for proper defense/compromise in the matter.

Vendor Management

Effectively engage, build relationships, and expand the existing network of advocates for creating a pool of advocates for better handling of cases.

Address the grievances of the vendor partners, provide trainings on latest developments with regards to legal aspects that impact their area of work as well as the latest developments in BAGIC.

Conduct regular and periodic review meetings to share feedback and improve the overall quality of services rendered by our external vendors.

To Select Appropriate Senior advocate considering technicalities, expertise and bench hearing the cases pending before the NCDRC and the Supreme Court.

Nurture new vendors by guiding them, providing them with relevant study materials to develop them to be future stakeholders in the success path of the organization.

Analysis and Reporting

Review MIS reports pertaining to claims management for cases pending before the NCDRC and the Supreme Court and draw insights that would be helpful to improve the performance of the team as well as vendor partners.

Apply trend analysis on certain types of cases, courts etc. that would be helpful in future cases to decide on whether to appeal/contest and the case strategy.

Assisting the Zonal in charge in discussion of cases, preparation of case notes, keeping track of the cases from the court websites for next date and status of cases.

Team development: -

Lead the team and provide advice and guidance on various areas related to arguments formation for cases, evaluation, and applicability of precedence etc.

Establish individual performance expectations and regularly review individual performance of the team.

Provide development opportunities (trainings of new judgments, their impact etc.) for team members to enhance technical knowledge and build domain expertise
